Kidnapper mistakenly released from Jefferson County Jail captured
UPDATE 12/17 9:45 p.m.: An inmate mistakenly released by the Jefferson County Jail last Friday is back behind bars.
The U.S. Marshall's Office located 35-year-old Matthew Burke Friday evening after a week long search. Burke is charged with the 2020 kidnapping of Birmingham businessman Elton B. Stephens.
Attorney Tommy Spina released the following statement to WVTM 13 after Burke was back in custody:
"On behalf of Mr. Stephens we’d like to thank law enforcement and specifically express our appreciation for the hard, persistent, tenacious work of the US Marshall’s office and the other agencies involved in apprehending this individual. We are relieved. It goes to show that you can run but you cannot hide."

The Jefferson County Sheriff’s Office is asking for the public’s assistance in locating an inmate who was released from jail by mistake.
Matthew Amos Burke, 35, of Remlap was released from the Jefferson County Jail in Birmingham on Friday, Dec. 10. He is described as approximately 5 feet, 7 inches tall, 170 pounds, with brown hair and blue eyes.
Burke was in holding there after he was transferred from a neighboring agency to attend court. He was charged with the 2020 kidnapping of Birmingham businessman Elton B. Stephens Jr.
Burke had charges with the state, which were dismissed after his court appearance on Friday.
The Jefferson County Sheriff's Office said the neighboring agency did not provide documentation to alert jail personnel that Burke was not to be released and had been sentenced by another court.
Monday afternoon it was discovered that Burke should have been held for transfer to prison, where he was to serve an already imposed sentence.
He has connections to the Fultondale, Tarrant and Remlap communities.
